Terms of Service

Payment Terms:

• All payments must be made 28 days in advance of the invoiced due date.
• Non payment will result in immediate account suspension, and after 7 days, the account will be removed.
• Mid-term account cancellations do not entitle a refund. Please see section on Cancellation for more information.

Special offers:

Any special offers or promotions may be revoked at any time and at the discretion of XBOLT.net.
Lifetime Offers: The term 'lifetime' is described as the working life of the XBOLT Network service, not as the lifetime of the user

Operation of service:

The service may be subject to necessary or premature closure at any point. Rebates of users subscriptions must be dealt with on a case-by-case basis. Any user seeking rebate of pre-paid subscription must indicate in writing that they seek a rebate for service already paid for, but not rendered. They may do this via email, to the following address:

In no way can the XBOLT Network, or any member of staff, be held responsible for any of the following points:

Lack of service due to networking or connection failures outwith our control.

Loss of service partially or completely, due to abnormal circumstances, such as (but not exclusively) hackers and power surges

Removal of users accounts for any reason covered within the Terms of Agreement and Disclamation (this document), which is updated from time to time

Misjudgement of the service provided herein on the part of the consumer. The service is laid out on the signup page and those points conform to the points laid out in the service plan. No other points may be presumed to be available to the consumer

Illegal Activity

XBOLT.NET does in no way condone illegal activity, such as electronic eavesdropping, cracking, or any other method of hacking (such as Denial of Service attacks - DOS).
The activities performed on our networks are monitored and if any suspicious activity is observed, a penalty of removal of service will be instated, or in worst cases, you will be handed over to the proper authorities.

Distribution of Illegal Content and storage or distribution of files

You may not at any time store any files for distribution to others that you do not have the explicit consent of the copyright holder to re-distribute. This includes distribution of Graphics, Audio (eg: MP3 files), Movies and Pirated Software. Your account will be immediately revoked if you are found doing this and you may be referred to the proper authorities for soliciting such material.

Spamming, Unsolicited Email and Abusive Email

Spam or Unsolicited email is something that we are very much against.
If you are found to be processing spam, or unsolicited email your account be removed and you will also be reported to any anti-spam associations. All information collected about you will be passed over to the proper authorities.

Other improper use of web services

Any web site which has been reported to us by any proper authorities may have their site subject to immediate suspension whilst investigation takes place.
We, may suspend any site at will for any reason which is favoured by ourselves.
Sites containing content which are not deemed fair, proper or decent all fall into this category.

Unix Access

Some customers may be granted access to our unix system if they have a valid reason for requiring this service. The following is not an exhaustive list of what areas are deemed unacceptable use whilst using the Unix shell.

Background Processes and Processor Consumption

With any web site, always check dynamic content such as PHP scripts and CGI scripts for errors which may cause the processor to facilitate a large amount of processor use, for example, an infinite loop.
Processor use is visible by logging into the Unix server and typing top at the command prompt.

Customers may not run background processess when logged in without first consulting with the support team with full information of what the background process is, and it's purpose. This includes crontab entries.

Executing Prohibited Software on our servers

• Eggdrops, BNCs or bots of any kind.
• IRCD (IRC Servers)
• Packet Sniffers or any tool that invites electronic eavesdropping
• Port Scanners such as NMAP
• ANY hacking software.
• ANY exploit software.
• Software considered to be illegal in your country or the United Kingdom

A user found to be using any of the above software may be subject to immediate termination as per decided by the System Administrator(s).

Cancellation, Termination and Reimbursement

Termination of an account can be enforced at the discretion of any of the XBOLT staff. Pro-rata reimbursement of sums due to unused service will not be paid out on customer cancellation, and on Termination by XBOLT, sums may only be obtained at the discretion of the management.
If the user wishes to Cancel, and claim a refund for an account, a valid reason for reimbursement must be made. No refunds will be given if the user has a 'change of mind'. Domain names are not refundable at any time after registration.

Monitoring

Your IP is logged whenever you log in, whenever you visit these pages, all commands are logged at the Unix shell, FTP and web access is also monitored closely.
